Welcome to Bailey Balloon Bar. By visiting our website and/or purchasing from us, you agree to be bound by the following Terms of Service. Please read them carefully before using our website or placing an order.

1. General

By using this site, you confirm that you are at least the age of majority in your state or province of residence, or that you have given us your consent to allow any minor dependents to use this site under your supervision.

We reserve the right to refuse service to anyone for any reason at any time.

2. Products and Services

Bailey Balloon Bar offers custom balloon gifts, balloon arrangements, stuffed balloons, bubble balloons, event décor, and related specialty items.

Because many of our products are customized, handmade, and made to order, slight variations may occur in color, size, shape, design placement, ribbon style, floral accents, gift contents, and overall presentation. We do our best to create each order as closely as possible to the product photos or approved design.

3. Custom Orders

Custom orders may require design approval, theme details, color selections, wording, and other event information before production begins.

It is the customer’s responsibility to review all submitted personalization details carefully, including:

names
dates
messages
colors
delivery information
special requests

Bailey Balloon Bar is not responsible for errors submitted by the customer after approval or checkout.

4. Pricing and Payment

All prices are listed in U.S. dollars and are subject to change without notice.

Full payment, or a required deposit where applicable, must be received before an order is confirmed. Orders will not be started until payment has been received and cleared.

We reserve the right to correct pricing errors, inaccuracies, or omissions at any time, including after an order has been submitted.

5. Deposits and Cancellations

For custom and event orders, a non-refundable deposit may be required to secure your booking date.

Because our items are custom-made and materials are purchased specifically for each order, all deposits are non-refundable unless otherwise stated in writing.

Cancellation requests made after production has started may not be eligible for any refund.

6. Refunds and Returns

Due to the personalized and perishable nature of balloon décor and custom gift products, all sales are final.

We do not accept returns or exchanges on:

custom balloon arrangements
personalized items
event décor
made-to-order gifts
items damaged after pickup, delivery, or setup completion

If there is an issue with your order, you must contact us within 24 hours of pickup or delivery with clear photos and a description of the concern. We will review the issue and, at our sole discretion, determine whether a partial refund, store credit, repair, or replacement is appropriate.

7. Balloon Care and Product Disclaimer

Balloons are delicate and can be affected by heat, cold, wind, direct sunlight, rough handling, sharp objects, ceiling texture, transportation conditions, and other environmental factors.

Bailey Balloon Bar is not responsible for popped balloons, shifting arrangements, oxidation, deflation, or other damage that occurs after pickup, delivery, or setup due to weather, venue conditions, handling, or circumstances outside our control.

Customers are responsible for proper balloon care once the order has been accepted.

8. Delivery and Pickup

Customers must provide accurate pickup and delivery information when placing an order.

For deliveries:

someone must be available to receive the order at the agreed time
delivery delays caused by incorrect addresses, inaccessible locations, no recipient present, or last-minute changes may result in additional fees
Bailey Balloon Bar is not responsible for delays caused by weather, traffic, venue restrictions, or other events beyond our control

For pickups:

once an order has been picked up and accepted, responsibility transfers to the customer
customers are responsible for ensuring their vehicle is suitable for transport

9. Event Installations

For event décor and installations, the customer must ensure the venue is ready and accessible at the agreed setup time.

Additional charges may apply for:

delayed access
waiting time
difficult load-in conditions
stairs
long walking distances
breakdown services
major last-minute changes

Any décor left unattended after setup is the customer’s responsibility.

10. Substitution Policy

From time to time, certain balloons, colors, ribbons, florals, containers, or specialty items may be unavailable due to supply shortages or vendor issues. Bailey Balloon Bar reserves the right to make reasonable substitutions of equal or greater value while preserving the overall style and theme of the design.

11. Gift Contents and Customer-Supplied Items

Some designs may include or accommodate gift items. Unless expressly stated, branded, luxury, designer, or specialty items are not included and must be supplied by the customer or purchased separately.

If customer-supplied items are used, Bailey Balloon Bar is not responsible for manufacturer defects, damage to fragile packaging already present at drop-off, or issues arising from the quality of customer-provided goods.

12. Intellectual Property

All content on this website, including text, images, branding, logos, product descriptions, graphics, and design concepts, is the property of Bailey Balloon Bar and may not be copied, reproduced, distributed, or used without written permission.

13. Photo Use

Bailey Balloon Bar reserves the right to photograph and share completed work for portfolio, website, social media, and marketing purposes unless the customer requests otherwise in writing before the order is completed.

14. Website Information

We strive to ensure that all information on our website is accurate and current. However, we do not guarantee that product descriptions, pricing, availability, colors, or other content will always be complete, accurate, or error-free.

We reserve the right to modify or discontinue products or services without notice.

15. Limitation of Liability

To the fullest extent permitted by law, Bailey Balloon Bar shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our website, products, or services, including but not limited to delays, product performance, balloon longevity, weather-related issues, or event-related losses.

Our maximum liability for any claim relating to a product or service shall not exceed the amount paid for that order.

16. Indemnification

You agree to indemnify, defend, and hold harmless Bailey Balloon Bar from any claim or demand, including reasonable attorneys’ fees, arising out of your breach of these Terms of Service or your violation of any law or rights of a third party.

17. Governing Law

These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of New Jersey and New York, without regard to conflict of law principles.

18. Changes to These Terms

We reserve the right to update, change, or replace any part of these Terms of Service at any time by posting updates to our website. It is your responsibility to check this page periodically for changes.
